1 Agreement to these terms

By accessing or using The Clearing (the "Service"), you agree to these Terms of Service. If you don't agree, please don't use the Service. We may update these terms from time to time, as described in Section 8.

2 What The Clearing is

The Clearing is a member-funded Medicare education platform. We provide clear-language information, tools, and an educational guide called Fern. We do not sell insurance, recommend or rank specific plans or carriers, enroll anyone, or earn commissions.

Nothing on the Service is legal, medical, tax, financial, or insurance advice. For decisions about specific plans, enrollment, or your health, consult a licensed professional, your state SHIP counselor, or Medicare directly at 1-800-MEDICARE.

3 Membership & billing

Some features require a paid membership. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. You can cancel anytime from your account; access continues through the end of the current billing period. Founding-member pricing, where offered, is described at sign-up.

Fees, taxes, and any setup charges are shown at checkout. We don't provide refunds for partial periods unless required by law.

4 Acceptable use

You agree to use the Service for your own personal, non-commercial education, and not to:

  • Misrepresent yourself, or use the Service to provide regulated advice to others;
  • Scrape, resell, or republish our content except as expressly permitted;
  • Interfere with the Service's security or operation;
  • Enter another person's sensitive personal identifiers without authorization.

5 Fern & AI tools

Fern is an educational AI guide, not a licensed insurance agent or professional advisor. It can be wrong. Verify exact rules, dates, and dollar amounts with Medicare.gov, your SHIP counselor, or a licensed professional before you act. Please don't enter Social Security numbers, Medicare numbers, account numbers, passwords, or full medical records.

6 Intellectual property

The Service's content, design, and trademarks are owned by The Clearing or its licensors. Free guides we mark as shareable may be printed and distributed for personal, non-commercial use without alteration or removal of attribution. All other rights are reserved.

7 Disclaimers & limitation of liability

The Service is provided "as is," without warranties of any kind. To the fullest extent permitted by law, The Clearing is not liable for any indirect, incidental, or consequential damages arising from your use of the Service or any decision you make. You are responsible for verifying information before acting on it.

The Clearing is not affiliated with, endorsed by, or connected to Medicare, CMS, the Social Security Administration, or any government agency.

8 Changes & contact

We may revise these terms; material changes will be reflected by the "last updated" date above. Continued use after changes means you accept them. Questions? Contact us.
